The commission shall not issue a permit of any class to any donut shop for the sale of alcoholic beverages. For purposes of this Section, "donut shop" shall be defined as an establishment: (1) Which sells donuts, pastries, or other confections; (2) Does not operate a fully equipped kitchen used for the preparation of uncooked foods, other than donuts, pastries, or other confections, for service and consumption of such foods on the premises; and (3) Does not prepare and serve uncooked foods, other than donuts, pastries, or other confections, at least five days a week.
