§1381.5. The Orleans Parish administration of criminal justice fund A. There is hereby created an Orleans Parish administration of criminal justice fund which shall be maintained and supervised by the criminal sheriff of the parish of Orleans for the purpose of collecting and distributing proceeds received from the annual licensing fee pursuant to R.S. 22:822. B.(1) All funds collected and deposited in the Orleans Parish administration of criminal justice fund are to be distributed per quarter within thirty days of receipt from the sources required to deposit funds. (2) Each quarterly distribution shall be calculated and allocated as follows: (a)(i) Twenty percent of all funds received to the Orleans Parish clerk of court. (ii) The funds received by the court pursuant to this Subparagraph shall be deposited into a special escrow account, retained for one year, and shall then be disbursed to the city of New Orleans to be used in defraying the expenses of the criminal justice system in Orleans Parish. No funds shall be disbursed from the special escrow account for any purpose previously set forth by the provisions of R.S. 13:1381.4 prior to August 1, 2020. (b) Twenty percent of all funds received to the Orleans Parish criminal sheriff's operating fund. (c) Twenty percent of all funds received to the Orleans Parish district attorney's operating fund. (d) Twenty percent of all funds received to the Orleans Parish indigent defender's program. (e) Twenty percent of all funds received to the Clerk of the Criminal District Court Expense Fund for the parish of Orleans. C. A committee shall be created consisting of the chief judge, or his designee, of the Orleans Parish criminal district court, the sheriff, or his designee, of the Orleans Parish criminal sheriff's office, the district attorney, or his designee, from the Orleans Parish district attorney's office and the director, or his designee, from the Orleans Parish indigent defender's program. This committee shall be empowered by unanimous consent to modify or alter the distribution of funds for emergencies or in the interest of the administration of criminal justice for the parish of Orleans. However, the committee may not authorize the payment of any funds to any entity other than those authorized by this Section to receive funds.
