Right to hearing

A. Prior to or during confinement under the provisions of this Title, any minor or his attorney shall have the right to demand a judicial hearing to determine if probable cause exists for his continued confinement under an emergency certificate. B. The hearing shall be held within five days of the filing of the petition. C. Pending the decision of the court, the minor patient shall remain confined unless the court orders release or a less restrictive status.
