Kentucky Code § KRS 80.380

Prerequisites to creation of authority for city, county or region

No governing body of a city or county shall adopt a resolution under KRS 80.320 to 80.610 declaring that there is a need for a housing authority to be created, or to exercise its powers within such city or county, or that there is a need to include such city or county within the area of operation of a housing authority, unless such governing body shall have found substantially that: (1) Unsanitary or unsafe inhabited dwelling accommodations exist in such city or county or that there is a shortage of safe o r sanitary dwelling accommodations in such city or county available to persons of low income at rentals they can afford; and (2) These conditions can be best remedied through the exercise of the housing authority's powers within the territorial boundaries of such city or county.
