Removal of county seat

(1) When a petition, signed in person by a number of legal voters of the county equal to twenty-five percent (25%) of the number of votes cast in the county at the last general election for county officers, is filed with the county judge/executive, asking for an election on the proposition of removing the county seat, the county judge/executive, by orders entered of record, shall call an election on that proposition to be held on the day of the next general election for county officers that does not occur withi n less than ninety (90) days from the filing of the petition. No order calling such an election shall be legal unless the place to which the county seat is proposed to be removed is specified in the petition and in the order calling the election. (2) The county judge/executive, by order entered of record, shall direct the sheriff to advertise the election and its object by publication pursuant to KRS chapter 424. (3) If two-thirds (2/3) of all legal voters who vote at the election vote for removal, the fiscal court shall provide for the removal of the county seat. (4) Elections under this section shall not be held oftener than once every ten (10) years in the same county.
