Kentucky Code § KRS 49.330

Application for award -- Filing of claim form -- Notification requirements -- Exemptions

(1) A claim form may be filed by a person eligible to receive an award, as provided in KRS 49.310 or, if the person is a minor, by his or her parent or guardian. (2) Claims shall be filed with the board in accordance with the administrative regulations promulgated by the board. The board shall accept for filing all claims submitted by persons eligible under subsection (1) of this section and alleging the jurisdiction requirements set forth in KRS 49.270 to 49.490 and meeting the requirements as to form in the administrative regulations of the board. (3) Upon filing of a claim pursuant to KRS 49.270 to 49.490, the board shall promptly notify the United State s attorney, if a federal offense is involved, and the Commonwealth's attorney or county attorney of the county wherein the crime is alleged to have occurred. (4) No claim may be filed by, or on behalf of, a person currently confined in any correctional facility, or any state institution maintained and operated by the Cabinet for Health and Family Services.
