If any member of the National Guard, when on duty or assembled therefor under lawful authority, does any act in the discharge of his duty that causes him to be proceeded against by civil court action, the Attorney General shall represent him in the civil proceedings. If, under the same conditions, a member of the National Guard is proceeded against in a criminal action, the adjutant general may, with the approval of the Governor, appoint legal counsel to represent him in the criminal proceedings. The compen sation paid the legal counsel shall be fixed by the adjutant general, with the written approval of the Governor.
