Notwithstanding any provision of this chapter to the contrary, there shall be, beginning on April 8, 1994, a two (2) year moratorium o n the levying of any mandatory fines or penalties pursuant to KRS 351.990 against the operator or miner who violates any provision of this chapter, except the two (2) year moratorium shall not apply to the penalty provisions of KRS 351.990(1), (2), (3), (4), (5), and (6).
