Criminal trespass on railroad property

(1) It shall be unlawful for any person without the consent of the railroad: (a) To go upon the track, property, or right-of-way of a railroad, other than to pass over the track, property, or right-of-way at a public or private crossing; or (b) To willfully ri de, drive, or lead any animal or otherwise contrive for any animal to go over the track, property, or right -of-way at a public or private crossing. (2) The provisions of this section shall not apply to any section of railroad track that has been legally abandoned and is not being used for railroad purposes. (3) Any person violating this section shall be guilty of criminal trespass in the second degree.
