Application for assessment referendum -- Contents of form -- Publication

(1) Any existing association which is fairly representative of the cotton growers of Kentucky may at any time after June 26, 2007, make application to the State Board of Agriculture on forms provided by the board for certification and approval for the purpose of conducting a referendum among cotton growers upon the question of levying an assessment upon the cotton growers to offset, in whole or in part, the cost of boll weevil or other cotton pest suppression or eradication programs. The application forms shall include but not be limited to the following: (a) Applicant's name and address; (b) Date; (c) Program to be undertaken for growers; (d) Brief statement of how the program is to be implemented; (e) Referendum to be conducted on a statewide or areawide basis; (f) Proposed effective date of the program; (g) Geographic area, by counties, of growers to be affected by the program; and (h) Signature of the applicant. (2) The Commissioner shall publish the application through the medium of the public press in the state within ten (10) days of receipt of the application.
