If, after an investigation or examination, the commissioner, Department of Kentucky State Police, believes that the evidence concerning a fire indicates that a crime has been committed, he or she shall furnish all data of an evidentiary nature in his or he r possession to the county attorney of the county in which the fire took place, or the Commonwealth's attorney in that district, and request that such attorney institute such criminal proceeding as the evidence warrants.
