Violations of KRS 217B.515 to 217B.585

The following acts are declared to be a violation of KRS 217B.515 to 217B.585: (1) Using any material or pesticide that is not labeled for the purpose of structural pest management; (2) Failure of a licensed operator or applicator to comply with any of the provisions of this chapter or any reasonable rule or regulation promulgated by the department; (3) Failure of any person to pay a fine or comply with an order issued by the department; (4) Failure to renew any required registration or pay any licensing fees; (5) Failure to obtain required continuing education units through training courses approved by the department; (6) Making a pesticide application not in accordance with the label registered by the department under KRS 217.542 to 217.640; (7) Storing or discarding a pesticide or pesticide container in a manner prohibited under KRS 217B.555; (8) Operating equipment not functioning as intended or designed by the manufacturer; (9) Operating equipment in a manner not intended or designed by the manufacturer; (10) Failure to keep and maintain the records required by the department, or to make reports when and as required; (11) Making false records, invoices, or reports; (12) Making an application of a pesticide by a trainee without having a licensed person providing direct supervision; (13) Making false representations in an application for a license or renewal of a license; (14) Failure to comply with any limitations or restrictions placed on a license issued by the department; (15) Impersonating any state, county, or city inspector or official; (16) Failure to obtain any license or make any registration required by this chapter; and (17) Failure to obtain or maintain liability insurance as required by this chapter.
