Before any violation of KRS 217.650 to 217.710 is reported to the Commonwealth's, county or city attorney for institution of a criminal proceeding, the person against whom such proceeding is contemplated may be given appropriate notice and an opportunity t o present his views to the cabinet, either orally or in writing, with regard to such contemplated proceeding. Nothing in KRS 217.650 to 217.710 shall be construed as requiring the cabinet to report for prosecution minor violations of KRS 217.650 to 217.710 whenever it believes that the public interest will be best served by a suitable notice of warning in writing.
