Any poisonous or deleterious substance added to any food except where such substance is required in the production thereof or cannot be avoided by good production or manufacturing practice shall be deemed to be unsafe for purposes of the application of KRS 217.025(1)(b), unless a tolerance for such substance has been prescribed under the federal act or the Federal Environmental Pesticide Control Act of 1972 and the quantity of such substance in or on the food is within the tolerance so prescribed or the sub stance has been exempted from the requirement of a tolerance under the provisions of the federal act or the Federal Environmental Pesticide Control Act of 1972.
