Kentucky Code § KRS 216B.178

Intermediate-care facility for individuals with an intellectual disability -- Application to increase number of beds -- Requirements

An application to increase the number of beds by an intermediate -care facility for individuals with an intellectual disability (ICF/ID) as defined in KRS Chapter 202B shall be consistent with the state health plan if the applicant: (1) Is an ICF/ID owned by a nongovernmental entity; (2) Requests additional beds in a freestanding building on or off the campus of the ICF/ID facility; (3) Demonstrates that the additional beds will be filled with individuals from the applicant's waiting list or from a community -based setting that the applicant currently supports; and (4) Demonstrates that each individual living at t he ICF/ID will have an individualized plan developed to improve their life experiences.
