Kentucky Code § KRS 211.935

Inspection of facilities -- Action to correct dangerous condition

(1) If, upon the inspection of a state confinement facility, the cabinet finds that a condition exists which endangers the health of those confined or likely to be confined in the facility, or the public health of the citizens of the Commonwealth of Kentucky, the cabinet shall advise the supervising and maintaining authorities, and shall enter the appropriate order to correct that condition. The supervision and maintenance authorities shall insure that those persons confined in a facility are notified of the findings. (2) In addition to the penalties provided by KRS 211.990(2), the cabinet may institute injunctive proceedings in Franklin Circuit Court to enforce any order given pursuant to subsection (1) of this section, and for which appropriate corrective acti on has not been taken.
