2026) (1) The Kentucky Board of Education, upon recommendation of the chief state school officer, shall promulgate an administrative regulation identifying instructional materials eligible for purchase with state instructional materials funds. The regulation shall ident ify instructional materials which are subject to review before being recommended for use, establish a procedure for the review, and a process for adding an instructional material to the state-approved list. (2) The department shall report the state -approved list of instructional materials for the use of school personnel as selected by the task force. (3) The chief state school officer, subject to the approval of the Kentucky Board of Education, may purchase instructional materials from the publishers or dev elopers whose instructional materials have been adopted by a school district for grades kindergarten through twelve (12) and distribute them without cost to the pupils attending the public schools in the school district. (4) Allocations and purchases using state instructional materials funds shall be conducted in accordance with KRS 156.395 to 156.476.
