Applications for permit -- Time for approval or rejection -- Emergency action plan administrative regulation

(1) All applications for permits required by KRS 151.250 shall be in the form and manner prescribed by the cabinet. (2) Unless waived by the cabinet, all plans and specifications submitted for approval shall be drawn by an engineer, licensed to practice as a professional engineer under the provisions of KRS Chapter 322. (3) Upon receipt of all plans and specifications, the cabinet shal l notify the applicant in writing within twenty (20) working days for a floodplain permit application, and within forty -five (45) working days for a dam permit application, either that the permit will be issued or denied, or that certain modifications in t he plans or specifications must be made before a permit will be issued. (4) The secretary may establish, by administrative regulation promulgated pursuant to KRS Chapter 13A, a requirement for the owner of any dam classified by the cabinet as high hazard, moderate hazard, or significant hazard to develop, exercise, and maintain an emergency action plan certified by the owner of the dam.
