Kentucky Code § KRS 149.093

Citation or ticket given violators in lieu of arrest

If the violation of any section of this chapter is a misdemeanor and is committed in the presence of a forest warden or other law enforcement officer, and there are reasonable grounds to believe that the person being cited will appear to answer the charge, the warden or officer may, in lieu of a physical arrest directed by KRS 149.090, issue a citation as authorized by KRS 431.015, 431.450, 431.452, and 431.455. The warden or officer may issue a warning without a penalty in lieu of a citation if the suspect ed offense is one cited in KRS 149.370, 149.375, 149.385, 149.390, 149.395, 149.400, 149.401, or 149.405.
