(a) The secretary of agriculture may adopt rules and regulations necessary for the administration and enforcement of the provisions of this chapter. As a part of such rules and regulations, the secretary of agriculture shall adopt standards setting forth specifications, tolerances and other technical requirements for all weights, measures and weighing and measuring devices, and point-of-sale systems. These specifications, tolerances and other technical requirements shall conform, insofar as practicable, to the specifications, tolerances and other technical requirements for weights, measures and weighing and measuring devices established by the national institute of standards and technology. The secretary of agriculture shall prescribe by rules and regulations the appropriate term or unit of weight or measure to be used whenever the secretary determines in the case of a specific commodity that an existing practice of declaring the quantity by weight, measure or numerical count, or combination thereof, does not facilitate value comparisons by consumers or such practice offers an opportunity for consumer confusion. (b) The secretary may adopt rules and regulations concerning: (1) Standards of workmanship for technical representatives and service companies; (2) requirements for contractual responsibilities and fulfillment of agreements by service companies; and (3) maintenance and furnishing of reports and information necessary for the secretary to carry out the provisions of this act.
