(a) (1) Notwithstanding any law to the contrary, a person granted licensure to maintain a day care facility may request from the secretary of health and environment a waiver from the requirements of this act for a set period of time. Waiver requests shall be made in a form and manner approved by the secretary and shall contain the provisions of the statute sought to be waived. (2) Such waiver request shall be submitted to the secretary and may be granted on a case-by-case basis. (b) (1) On and after July 1, 2026, notwithstanding any law to the contrary, a person granted licensure to maintain a day care facility may request a waiver from the requirements of this act for a set period of time. Waiver requests shall be made in a form and manner approved by the director of early childhood and shall contain the provisions of the statute sought to be waived. (2) Such waiver request shall be submitted to the deputy director of child care licensure and finance. Upon a recommendation by the deputy director of child care licensure and finance on a case-by-case basis, the director may grant a waiver. (c) From July 1, 2025, through June 30, 2026, this section shall be a part of and supplemental to article 5 of chapter 65 of the Kansas Statutes Annotated, and amendments thereto.
