(a) Any person who generates a total of 2.2 pounds (one kilogram) or more of acutely hazardous waste, as defined by subsection (y) of K.S.A. 65-3430, and amendments thereto, in any calendar month shall be subject to regulation by the secretary pursuant to K.S.A. 65-3430 et seq., and amendments thereto. (b) Any person who generates any hazardous waste, which is not an acutely hazardous waste, in any calendar month shall be subject to regulation by the secretary pursuant to K.S.A. 65-3430 et seq., and amendments thereto, in accordance with the following schedule: (1) From and after July 1, 1984, all persons generating 165 pounds (75 kilograms) or more per month; (2) from and after July 1, 1985, all persons generating 110 pounds (50 kilograms) or more per month; (3) from and after July 1, 1986, all persons generating 55 pounds (25 kilograms) or more per month.
