Any person subject to this code shall be punished at the direction of a commanding officer if such person, while in the hands of a hostile force in time of war or civil disturbance: (a) For the purpose of securing favorable treatment by the person's captors, acts without proper authority in a manner contrary to law, custom or regulation, to the detriment of others of whatever nationality held by the enemy as civilian or military prisoners; or (b) while in a position of authority over such persons, maltreats such persons without justifiable cause.
