K.S.A. 17-76,148 through 17-76,155, and amendments thereto, apply to all statutory public benefit limited liability companies, as defined in K.S.A. 17-76,149, and amendments thereto. If a limited liability company is formed as or elects to become a statutory public benefit limited liability company in the manner prescribed in this section, such limited liability company shall be subject in all respects to the provisions of the Kansas revised limited liability company act, except to the extent that K.S.A. 17-76,148 through 17-76,155, and amendments thereto, impose additional or different requirements, such additional or different requirements shall apply, and notwithstanding K.S.A. 17-76,134, and amendments thereto, or any other provision of the Kansas revised limited liability company act, such additional or different requirements imposed by K.S.A. 17-76,148 through 17-76,155, and amendments thereto, may not be altered in the operating agreement. If a limited liability company is not formed as a statutory public benefit limited liability company, such limited liability company may become a statutory public benefit limited liability company in the manner specified in its operating agreement or by amending its operating agreement and articles of organization to comply with the requirements of K.S.A. 17-76,148 through 17-76,155, and amendments thereto.
