Ifthe adjoining owner contributes one-half of the expense ofbuilding such wall, then itisa wall in common between them, but ifthe adjoining owner refuses to contribute, the adjoining owner shall have the right to make ita wall in common by paying to the person who erected or maintained itone-half of its appraised value at the time of using it.
