1. Any person who operates or permits to be operated as a school bus to transport pupils, any vehicle which does not comply with the requirements provided by law or by the rules and regulations of the department of education, or for which there isnot a valid temporary certificate for operation, shall be guilty of a simple misdemeanor. 2. A vehicle used for an approved driver education course in which the driver education teacher transports driver education students from their residences for street or highway driving isnot a school bus.
