Any lot of commercial fertilizer or beneficial substance not in compliance with the provisions of this chapter shall be subject to seizure on complaint of the secretary to a court ofcompetent jurisdiction inthe county or adjoining county in which the commercial fertilizer or beneficial substance is located. In the event the court finds the commercial fertilizer or beneficial substance to be in violation of this chapter or an order for the condemnation of the commercial fertilizer or beneficial substance, the commercial fertilizer or beneficial substance shall be disposed of in any manner consistent with the quality of the commercial fertilizer or beneficial substance and the laws of the state. However, the disposition of the commercial fertilizer or beneficial substance shall not be ordered by the court without firstgiving the claimant an opportunity to apply to the court for release of the commercial fertilizer or beneficial substance or for permission to reprocess or relabel the commercial fertilizeror beneficial substance to bring itinto compliance with this chapter.
