Immunity from civil liability

Sec. 8. (a) The following are immune from civil liability for an act or omission occurring during a motorcycle operator safety education course that results in an injury or property damage: (1) The state of Indiana. (2) A regional training center contracted by the bureau or any other site approved by the commissioner to provide motorcycle driver education and training courses. (3) The owner of a site upon which a motorcycle operator safety education course is conducted. (4) An officer, agent, or employee of a person described in subdivisions (1) through (3).       (b) The immunity described in subsection (a) does not apply if the person committed gross negligence or willful or wanton misconduct.   IC 9-28 ARTICLE 28.
