Sec. 3.1. (a) Notwithstanding section 3 of this chapter, any member of the commission may issue an original letter of extension extending the term of a permit for a maximum period of ninety (90) days for good cause shown upon the written request of the permittee and payment of the fee if required. (b) Upon the expiration of an original letter of extension, or any renewal thereof, if good cause still exists, subsequent renewals of the extension may be granted to that permittee only upon the affirmative vote of a majority of the members of the commission. Any member of the commission may issue a subsequent extension if the need for a subsequent extension is due to an act or omission of: (1) the commission; (2) a local board; or (3) a third party that is unrelated to the permittee involved and is not employed by or under the control of the permittee.
