Sec. 3. "Domestic violence" includes conduct that is: (1) an element of an offense under IC 35-42 or a threat to commit an act described in IC 35-42 by a person against: (A) a family or household member; or (B) an incapacitated individual under the guardianship or otherwise subject to the control of the person; (2) an element or threat to commit an act constituting an element of a misdemeanor or felony under the laws of: (A) the United States; (B) another state; or (C) an Indian tribe; that is substantially similar to an offense described in subdivision (1); or (3) an attempt or conspiracy to engage in conduct described in subdivision (1) or (2); regardless of whether the act or threat has been reported to a law enforcement agency or results in a criminal prosecution or whether the person who engages in the conduct is an adult.
