Indiana Code § 36-9-27-60

Establishing new regulated drains; hearing on petition; consideration of remonstrances and objections

Sec. 60. (a) At its hearing on a petition to establish a new regulated drain, the board shall consider: (1) any remonstrance filed under section 59(a) of this chapter; and (2) any objection filed under section 59(b) of this chapter.       (b) If the board finds that a proper remonstrance has been filed, it may dismiss the petition. If the board does not dismiss the petition, it shall forward the petition to the county surveyor for a final report.       (c) If the board finds that a proper objection has been filed, the person against whom the objection is made shall disqualify himself or herself from any further action in the proceedings to establish the drain.
