Indiana Code § 36-9-14-7

Courthouse fund; transfer of funds to nonprofit corporation maintaining or renovating courthouse

Sec. 7. (a) The tax money collected under this chapter shall be held in a special fund to be known as the courthouse fund.       (b) For purposes of this chapter and IC 36-9-14.5 , the portion of the property tax levy designated for a courthouse described in section 2(b) of this chapter may be transferred to a nonprofit corporation that has a lease with the county requiring the corporation to maintain or renovate the courthouse. Before appropriated funds may be transferred to a qualified nonprofit corporation, the corporation must submit a plan for the use of the funds to the county fiscal body for its approval. An officer or employee of a corporation who receives funds under this section and knowingly uses the funds for a purpose other than a purpose approved by the fiscal body commits a Level 6 felony.
