Sec. 3. As used in this chapter, "executive" means the following: (1) In the case of a county that does not have a consolidated city, the president of the board of county commissioners. (2) In the case of a county having a consolidated city, the mayor. (3) In the case of a city, the mayor. (4) In the case of a town that: (A) does not have a mayor, the president of the town council; or (B) does have a mayor, the mayor.
