Attorney's fees and costs for prevailing remonstrators

Sec. 11.6. (a) This section applies to a remonstrance filed after June 30, 2015.       (b) If the court orders an annexation not to take place after a hearing under section 11 of this chapter, the remonstrators shall be reimbursed by the annexing municipality for any reasonable attorney's fees, including litigation expenses and appeal costs: (1) that are incurred: (A) after the date the annexation ordinance is adopted; and (B) in remonstrating against the annexation; and (2) not to exceed thirty-seven thousand five hundred dollars ($37,500).
