Failure of eligible county or unit to make transfer to commission

Sec. 36. (a) This section applies if an eligible county or an eligible unit fails to make a transfer or part of a transfer required by section 28 of this chapter.       (b) The treasurer of state or treasurer of county, as applicable, shall do the following: (1) Withhold an amount equal to the amount of the transfer or part of the transfer under section 28 of this chapter that the eligible county or eligible unit failed to make from money in the possession of the state that would otherwise be available for distribution to the eligible county or eligible unit under any other law. (2) Pay the amount withheld under subdivision (1) to the commission to satisfy the eligible county's or eligible unit's obligations to the commission.   IC 36-11 ARTICLE 11.
