Unlawful competitive bidding

Sec. 4. (a) As used in this section, a "purchase" means: (1) the purchase of materials, equipment, goods and supplies for at least ten thousand dollars ($10,000); or (2) the leasing of equipment for at least five thousand dollars ($5,000).       (b) A state purchaser of materials (as described in IC 5-17-1 ) who fails to advertise (as defined in IC 5-3-1 ) for, receive, or consider bids for purchase commits unlawful competitive bidding, a Class C infraction. However, the violation is a Class A misdemeanor if it is committed knowingly or intentionally and the person has a prior unrelated adjudication or conviction for a violation of this section within the previous five (5) years.
