Sec. 34. In an action to recover the possession of personal property, if the property has been delivered to the plaintiff and the defendant claims a return of the property, judgment for the defendant may be for: (1) the return of the property, or its value, in case return is not possible; and (2) damages for the taking and withholding of the property.
