Sec. 17. (a) A charitable trust may be created for the following purposes: (1) The relief of poverty. (2) The advancement of education or religion. (3) The promotion of health. (4) Governmental and municipal purposes. (5) A purpose that is beneficial to the community. (b) If the terms of a charitable trust do not indicate a particular charitable purpose or beneficiary, the court may select at least one (1) charitable purpose or beneficiary. The selection must be consistent with the settlor's intention to the extent the intention can be ascertained. (c) The settlor of a charitable trust, among other persons, may maintain a proceeding to enforce the charitable trust.
