Sec. 44. (a) The county chairman of each major political party of the county may appoint one (1) person to observe: (1) the ordering and the setting and adjustment of automatic tabulating machines under section 6 of this chapter; (2) the testing of automatic tabulating machines under section 22 of this chapter; and (3) the determination of the cause of and correction of errors in the counting of ballot cards under section 25 of this chapter. (b) The county chairman shall file the name of a person appointed under this section with the circuit court clerk. (c) A person appointed under this section serves until: (1) the county chairman notifies the circuit court clerk that the person's appointment has been revoked; (2) the county chairman notifies the clerk that the person has died; or (3) the person files a letter of resignation with the clerk. (d) A person appointed under subsection (a): (1) may attend the ordering and the setting and the adjustment of the automatic tabulating machines only as a witness; (2) shall remain silent and subject to the orders of the board; and (3) may not obstruct or interfere with the ordering and setting and adjustment of the automatic tabulating machines. (e) A person appointed under subsection (a) is not entitled to compensation for services except from the political party of the county chairman making the appointment. IC 3-11-14 Chapter 14.
