Violations; department's authority to impose civil penalty; amount

Sec. 1105. (a) If the department determines, after notice and an opportunity to be heard, that a person has violated this chapter, the department may, in addition to or instead of all other remedies available under this chapter, impose upon the person a civil penalty not greater than ten thousand dollars ($10,000) per violation.       (b) A penalty collected under this section shall be deposited into the financial institutions fund established by IC 28-11-2-9 .
