Principles applying to public adjuster contracts

Sec. 17. The following apply to a contract between an insured and a public adjuster: (1) An insured is not required to hire a public adjuster to help the insured meet the insured's obligations under a policy, but has a right to do so. (2) The public adjuster is not a representative or employee of the insurer. (3) The salary, fee, commission, or other consideration to be paid to the public adjuster is the obligation of the insured, not of the insurer, except when the insured has assigned the insured's rights to the public adjuster.
