Sec. 1.8. As used in this chapter, "authorized distributor" means a wholesale drug distributor with which a manufacturer has established an ongoing relationship to distribute the manufacturer's products. For purposes of this section, an ongoing relationship exists between a wholesale drug distributor, including any affiliated group (as defined in Section 1504 of the Internal Revenue Code) of which the wholesale distributor is a member, and a manufacturer if the wholesale drug distributor: (1) has a written agreement currently in effect with the manufacturer evidencing an ongoing relationship; (2) is listed on the manufacturer's current monthly updated list of authorized distributors; or (3) has a verifiable account with the manufacturer and a minimal transaction or volume requirement limit of: (A) five thousand (5,000) units per company in the previous twelve (12) months; or (B) twelve (12) purchases at the manufacturer's minimum purchasing requirement per invoice in the previous twelve (12) months.
