Effective 1-1-2026. Sec. 3. The obligations imposed on a controller or a processor under this article do not apply if compliance by the controller or processor with this article would violate an evidentiary privilege under Indiana law. This article shall not be construed to prohibit a controller or processor from providing, as part of a privileged communication, personal data concerning a consumer to a person covered by an evidentiary privilege under Indiana law.
