Indiana Code § 23-2-2.5-2

Application of chapter

Sec. 2. This chapter applies to an offer or franchise if:       (a) the offeree or franchisee is an Indiana resident; or       (b) the franchised business contemplated by the offer or franchise will be or is operated in Indiana.       An offer to sell is not made in this state because the franchisor circulates or there is circulated on his behalf in Indiana an advertisement in: (1) a bona fide newspaper or other publication of general, regular and paid circulation which has had more than two-thirds (2/3) of its circulation outside this state during the past twelve (12) months; or (2) a radio or television program originating outside this state which is received in Indiana.
