Disciplinary action for students with disabilities

Sec. 34. (a) Notwithstanding any other law, a suspension, an expulsion, or another disciplinary action against a student who is a student with a disability (as defined in IC 20-35-1-8 ) is subject to the: (1) procedural requirements of 20 U.S.C. 1415; and (2) rules adopted by the state board.       (b) The division of special education shall propose rules to the state board for adoption under IC 4-22-2 governing suspensions, expulsions, and other disciplinary action for a student who is a student with a disability (as defined in IC 20-35-1-8 ).
