Indiana Code § 20-32-3-2

Sec. 2. As used in this chapter, "student" refers to a student who meets the following conditions: (1) Is enrolled in a public school, a state accredited nonpublic school, or a nonpublic school that has requested and received from the state board specific approval for the school's education program. (2) Is in at least grade 9. (3) If the student is a student with a disability (as defined in IC 20-35-1-8 ), would benefit from the participation under this chapter as determined by the individualized education program for the student.
