Sec. 36. (a) Each school year, the governing body of a school corporation may spend an amount for remediation programs for students enrolled in kindergarten through grade 12 not to exceed one percent (1%) of the state tuition support that the school corporation receives for the school year. (b) A remediation program for any subset of students enrolled in kindergarten through grade 12 must be in writing and adopted at a public hearing of the governing body of the school corporation before the governing body may spend money for the remediation program. (c) After the governing body of a school corporation adopts a remediation program under subsection (b), the school corporation shall promptly file the adopted plan with the department. The department shall review a plan for a remediation program adopted by the governing body of a school corporation and may comment on the plan.
