Sec. 4. (a) The board may suspend a permit issued under section 3 of this chapter whenever: (1) there is reason to believe that a public health hazard exists; (2) the permit holder has violated any of the requirements of this chapter; or (3) the permit holder has interfered with the board in the performance of the board's duties. (b) The board shall: (1) in all cases except where the milk or milk product involved creates or appears to create an imminent hazard to the public health; or (2) in any case of a willful refusal to permit authorized inspection; serve upon the permit holder a written notice of intent to suspend the permit under IC 4-21.5 . A suspension of a permit is effective immediately and remains in effect until the violation has been corrected to the satisfaction of the board.
