Sec. 51. (a) All state agencies, municipal corporations, and other governmental agencies are subject to this chapter and rules adopted under this chapter concerning the application of restricted use pesticides. (b) Except as provided in subsection (c), a person may not act as a licensed public applicator unless the person has obtained a license from the state chemist. (c) A person who is not a licensed public applicator may use a restricted use pesticide if the person is under the direct supervision of a licensed public applicator. (d) The public applicator's license is valid only when the applicator is using or supervising the use of restricted use pesticides by public agencies. Government research personnel are not exempt from the licensing requirement when using restricted use pesticides. [Pre-2008 Recodification Citation: 15-3-3.6-8.]
