Condemned pesticides disposal

Sec. 75. (a) If a pesticide product is condemned under this chapter, the court shall enter a decree ordering the: (1) disposal; (2) destruction; or (3) sale; as the court may direct.       (b) If the pesticide product is sold under subsection (a), the proceeds, less legal costs, shall be paid to the state chemist.       (c) A pesticide product described in subsection (a) may not be sold except as provided for in this chapter.       (d) After: (1) payment of costs; and (2) execution and delivery of a good and sufficient bond that stipulates that the pesticide product may not be disposed of unlawfully; the court may direct that the pesticide product be delivered to the owner of the pesticide product for relabeling or reprocessing.
